Legal Eagle Q & A: Black Friday!

November 23, 2017 by Melinda @ Giles Wilson Solicitors

Question: Last year I bought something in the Black Friday sale, and then two weeks later it was for sale at a lower price. I don’t want to get caught out again like that this year, can I demand the difference?

Answer: You will need to check the retailer’s return policy and in particular if they have a policy relating specifically to Black Friday. If the policy is silent on the matter or there is not a returns policy and the retailer will not use their discretion; then you would not be able to demand a refund.

One way around this would be to return the goods, claim a refund and then purchase the goods at a lower price. However, again unless the store has a returns policy allowing for non-fault returns, you cannot demand a refund. Conversely consumers who purchase goods online have greater protection under the Consumer Contracts Regulations and can cancel the purchase for any reason but must do so within 14 days.
