Question:  I have read in the news about Buzz Aldrin suing his children for mis-using his money under a Power of Attorney – I thought it was a good idea to appoint an Attorney but now I am nervous!

Answer:  It is a shocking story I agree and although that took place in the USA, financial abuse under a Power of Attorney can and does take place here also.  The important thing is to choose Attorneys carefully, I would also say to obtain advice in making a Power of Attorney as there are safeguards that can be put in place too. It is of course against the law to steal from someone – it is a “fraud by abuse of position”, but can be difficult to prove if the Power of Attorney has given complete access to finances.
