Legal Eagle Q & A: In light of a divorce, where does the law stand on who the children live with?

April 14, 2019 by Melinda @ Giles Wilson Solicitors

Question: My wife has been having an affair and I really feel that we need to part and go for a divorce. But I know I’ll lose my kids. Is it always the case that the children live with their mum?

Answer: Firstly I’m sorry that you are in this upsetting situation. However, there is no foregone conclusion regarding where your children will live. The law says that this must always be decided in the best interest of each child. I hope this helps.
