Legal Eagle Q&A: Neighbours & Shared Driveways

July 22, 2018 by Melinda @ Giles Wilson Solicitors

Question: We have a shared driveway but neither us nor our neighbours use it. They are now saying they want to put a fence on the boundary and use it like a garden – can they do that?

Answer: You would need to check the deeds to your property as it is likely that the restrictions do not allow this as you probably have a right of way over the boundary and their land as they do over you if it has been set up as a shared driveway.  If you both agree that you want to change things permanently you may be able to reach a legal agreement that would need to be documented.  So the first step is to get your deeds checked by a solicitor.
