Legal Eagle Q&A: Should I get a pre-nup?

Question: My boyfriend and I are getting married later this year. I already own a house that I inherited from my dad and my friends are telling me that I should get a pre-nup. What is your advice? Are they legal? It seems very unromantic.

Answer:Pre-nuptial agreements are not actually legal binding in the UK but the courts do place a lot of weight on them if you were to make one and then get divorced. They have to be entered into correctly for the court to take them into account but matrimonial law does over-ride. They do sound unromantic but we also find many couples very keen to be honest and open with each other (especially whilst they are still happy!) so don't be afraid to seek advice.
