Legal Eagle Q & A: Dodgy pavement's & claim potential!

Question:
 I was walking along one of the roads that lead to Leigh Broadway when I tripped on a dodgy bit of the pavement. Can I make a claim? My friend said I was so busy chatting that I wasn’t looking where I was going and so it’s my fault!

Answer: The local authority has a responsibility to keep the pavements in a good state of repair so that we don’t trip on defects so it is possible that you have claim. It would depend upon the defect itself, the injury that you suffered and yes, the circumstances too. Oh, and you must claim within 3 years!
