Legal Eagle: Can I Replace a Fence that My Neighbour Claims is His?
Question: When I bought my house the garden fence was very tatty. I was told that it belonged to the neighbour and I have asked them to replace it but they have not. Can I just replace it myself?
Answer: You can put up a new fence on your side of their fence so that it is on your land but you cannot take down their fence as it belongs to them. If however, this is part of a bigger problem it is best to seek legal advice on your specific neighbour dispute but I hope this helps for now.
