Legal Eagle Q+A: Can I Overturn A Will?

September 7, 2016 by Melinda Giles

Q: Someone really close to me recently died, and I am really shocked by their Will as I always thought I would inherit. It’s not about the money - it’s that I am now wondering how it happened and whether I misjudged how they felt about me, or whether the people that have inherited in stead of me were somehow tricking her. Is there anything I can do about it?

A: Certainly, and in fact you should do. Whether the will was made by a solicitor or not, there are steps that can be taken to find out more about the way that the Will was made. Undue influence by beneficiaries, or a lack of understanding by the person making the Will are all valid reasons for overturning a Will. If you were in a relationship with the deceased, financially maintained by them, then you may have an additional claim. I would urge you to seek advice but do so urgently as there are time limitations.
