Legal Eagle Q&A: Relationships, Divorce & Inheritance

November 14, 2016 by Melinda Giles at Giles Wilson Solicitors

Question; My son and his wife are not getting on and I am nervous that if he inherits from me, she will get everything on a divorce. Is that true and what can I do about it?

Answer: Timing is everything. If your son divorces whilst you are healthy and well (and by that I mean alive!), then any financial settlement will not take into account the fact that he is likely to inherit from you. However, if he has inherited from you either before or during a divorce then his inheritance will be taken into account with all the finances that the couple have between them. There is not a great deal that you can do with certainty when there are so many uncertainties but you should mention your concerns when making a Will and your particular circumstances will determine options.
