Legal Eagle Q & A: Right's on name changing

February 19, 2018 by Melinda at Giles Wilson Solicitors

Question: I split up with my partner when my son was 6 months old and I would like to change my son’s surname to mine.  Is it legal to do that?

Answer: This will depend upon the whether your partner has Parental Responsibility, and in any event should be done by a statutory declaration that my require both parents to agree. But certainly it may be possible.
