Legal Eagle Q&A: Leigh Cafes & Staff Christmas Cover

November 28, 2016 by Melinda @ Giles Wilson Solicitors

Question: I run a cafe in Leigh Broadway and would like to open on Christmas day but my employees are insisting that they are entitled to the day off. What is the position?

Answer: Surprisingly there is no legal right to paid leave on Bank Holidays. This will all depend upon the terms of the employment contract issued to each employee. If your business is one that wishes to open on Bank Holidays it is worth drafting the appropriate provisions in the contract, to cover these points so that both you and your employees are clear on the position.
