Legal Q&A: Icy Paths & Liability

Question: I was recently asked whether as a householder I would be liable if the postman injured himself slipping on ice on my path whilst posting a xmas card through my door. What is the answer?

Answer: There is no definite answer to this but it is possible that you would be liable if you had not taken enough care to ensure that the pathway was safe enough for those visiting your home. But this has to be reasonable and if everywhere is exceptionally icy and it has not been possible to clear it, then probably you would not have a specific liability. There is a bigger responsibility if you are a business inviting customers.
