Legal Eagle: Rights of the homeless

August 27, 2017 by Melinda @ Giles Wilson Solicitors

Question: I know that we are supposed to be neighbourly and kind to everyone, but I am unhappy about some people that seemed to have moved their tents permanently onto some wasteland next door to my house. What can I do about it?

Answer: This depends upon who the land belongs to. We can look up ownership at the Land Registry for you and then contact the owner who may not be aware that these people are trespassing on their land. We can also find out if the land is public and has any bye-laws on it and then it is a matter of alerting the Local Authority. Bit of a problem if the owner of the land just prefers to live in a tent – but if he starts to hold a music festival without the right permission then that is definitely a nuisance that can be dealt with!
