Legal Eagle Q&A: Wills

November 27, 2017 by Melinda @ Giles Wilson Solicitors

Question: An old neighbour of mine has died and in her will she has left me £30k legacy but she went into a care home and there is no money left. What happens? Do I get what is left?

Answer: It will depend upon the exact wording of the Will. It could be, if there were lots of fixed sum legacies, that each of you will get what is left shared proportionate to your legacies. It is the responsibility of the Executor to the Will to deal with it and they must follow the law when doing so.
