Know your rights!

Know your rights!

As I’m sure most of you are aware the main parts of the Consumer Rights Act 2015 came into force at the start of the month.

UK consumers spend £90 billion a month. Transparent rights will help them to make better choices when they buy and save them time and money.

If you are a business that sells directly to consumers than it is worth ensuring that you know what the implications of the new act are and how you may need to deal with such elements such as complaints, refunds etc.

The new set of single set of rules applies to ALL contracts where goods and services are supplied to consumers and includes specific rules for the provision of digital content such as computer operating systems, mobile apps and downloads.

The key points are

• You have 30 days to get a refund on any product.
• After one failed attempt by the retailer to repair or replace a faulty item, you're entitled to ask for a refund or price reduction.
• No deduction can be made from a refund in the first six months after purchase. (rules on motor vehicles vary)
• Online digital content that is paid for, supplied free with other paid for items and digital content supplied on a physical medium, such as a DVD are now covered.
• Unfair terms in consumer contracts it will now be easier for consumers to challenge hidden fees and charges. Key terms of a contract, including price, may be assessed for fairness unless they’re both prominent and transparent.

In light of these and other changes it is worth looking in more detail at http://www.businesscompanion.info/en/news-and-updates/consumer-rights-act

It is also worth checking with your solicitor that your company’s contract terms are up to date and that you are properly insured against claims.
