Legal Eagle Q & A: The revisiting of matrimonial finances

April 29, 2018 by Melinda @ Giles Wilson Solicitors

Question: After my finances were sorted by the court, my situation has changed and now the agreement is unfair. Is there anything I can do?

Answer: If the division of your matrimonial finances has been by a court order, the effect of a change in your financial circumstances afterwards will vary.   An award for a payment of a lump sum by instalments over time or an award for spousal maintenance can sometimes be varied by a later application.

However if a final order has been made by the court, there are very limited circumstances in which a court will be prepared to reconsider the form of a final order.
