Legal Eagle Q & A: Is a Valentines Day gift for keeps?

February 13, 2018 by Melinda at Giles Wilson Solicitors

Question: I am planning to give my girlfriend a really special gift for Valentine’s day – I have ordered a brand new car for her.  Then my mate asked me whether I would get it back if we split up – not a very romantic thought but it did make me wonder?

Answer: This will all depend upon whether it is a conditional gift – so if you give it to her outright then it belongs to her, but if you say she can use it whilst you are a couple then there is a difference and it remains yours if you are no longer a couple.

Happy Valentine’s Day!
