Legal Eagle Q & A: Where you stand legally when the executor of a will is not forthcoming

June 10, 2018 by Melinda @ Giles Wilson Solicitors

Question: My gran died 15 months ago and my uncle is the Executor of the will but he has not told me what is going on or when we are likely to receive our inheritance.  Can I do anything about it?

Answer: Once a year has passed by, beneficiaries have a right to interest on legacies due to them that have not been paid, and the Executor is answerable to questions as to why the estate is not finalised.  So, I would certainly recommend that you ask him, maybe formally now, what is going on.  Good luck!
