Giles Wilson - Legal Eagle Q&A

Giles Wilson - Legal Eagle Q&A New to leigh-on-sea.com, Melinda Giles from Giles Wilson Solicitor's is here, answering your weekly legal queries!

Question: My neighbours living at the bottom end of our garden have some massive conifers that are so tall that they shade most of my garden. Am I within my rights to get a ladder and chop them?

Answer: The trees belong to your neighbour so although you can cut them down (if they aren’t subject to a tree preservation order by the council) you can only do so to the extent that they overhang your garden. But remember that the trees do belong to your neighbour so you should not throw them away but offer to return them! Word of warning; neighbourhood disputes can turn ugly and expensive so do your best to avoid them! Perhaps invite your neighbours over to sit in the shade for a glass of wine with you.
